______________

KENYATAAN AKHBAR/PRESS STATEMENTOLEH/BY: ZAINUL RIJAL ABU BAKAR
TEMPAT/VENUE: BILIK AKHBAR, KOMPLEKS MAHKAMAH JALAN DUTA
TARIKH/DATE : 03.06.08 3.00 petang
TAJUK/TITLE : PERMOHONAN MENCELAH (INTERVENE) TERHADAP KEPENGGUNAAN KALIMAH “ALLAH” DI DALAM PENERBITAN ‘HERALD-THE CATHOLIC WEEKLY’
DALAM MAHKAMAH TINGGI KUALA LUMPUR
NO R1-25-73-08 DAN R2-22-12-07

(English Version)

1. Majlis Agama Islam of the States of Perak and Wilayah Persekutuan had respectively filed applications for leave to intervene in the cases filed by the Titular Roman Catholic Church (“the Church”) for judicial review and declaration of rights among others as follows:

a) usage of the word ‘Allah’ in the Church’s publication ‘Herald-theCatholic Weekly’;
b) challenge Guidelines issued by the Malaysian government under thePrinting Presses and Publications Act prohibiting the use thewords ‘Allah’, and
c) the word ‘Allah’ is not exclusive for the religion of Islam.

2. The repercussion of the decision of the judicial review/declaration of rights may:-

(i) allow the Church to use the word ‘Allah’ in the Church’spublication ‘Herald-the Catholic Weekly’;
(ii) allow the Church to claim the right to use the words ‘Allah’,
(iii) cause confusion in religion affecting security, peace and harmony ofgeneral public and Muslim community.

3. The intervention by Majlis Agama Islam of States is essential to avoid confusion in religion caused by the usage of the words ‘Allah’, that may affect the security, peace and harmony of the general public and cause religious sensitivities.

4. Majlis Agama Islam of States are responsible to ensure the protection of the integrity of the word ‘Allah’ which is fundamental in the Muslim Belief. The concept of Allah as understood, embraced and practised by the Muslim community in Malaysia is totally distinct and separate from the concept as understood by the Church conceptually, culturally and theologically.

5. It is essential for Majlis Agama Islam of States to intervene when Muslims’ rights and interests are affected.

6. Thus, challenging the integrity of the word ‘Allah’ strikes at the very root of Muslim Belief and transcends the mere application of the word ‘Allah’ to refer to ‘God’ as perceived by the Church.
